Terms & Conditions
These Terms and Conditions ("Terms") govern the sale of products, including fresh produce, pastured poultry, herbal products, and related goods ("Products"), by Long Ago Lake Farmstead LLC ("we," "us," or "our") to customers ("you" or "Customer"). By placing an order or purchasing Products from us, you agree to be bound by these Terms. These Terms may be updated from time to time; the most current version will be posted on our website or provided with your order confirmation. Users of this website, customers, visitors, are responsible for self education on the uses, and risks of all plants, animals, and products mentioned or sold here. The information and opinions presented on this site, on any associated blogs, social media pages, not limited to this platform is shared for educational and entertainment purposes only and is not intended to diagnose, prevent, or treat any medical conditions and does not constitute health advice nor is it a substitute for medical treatment. Consult with a medical professional or physician regarding any decisions concerning changes in diet or before consuming any health products, existing or potential allergies, contraindications based on medical conditions or interactions with prescription medications.
1. Product Descriptions and Availability

Product descriptions, including weights, varieties, and harvest dates, are provided for informational purposes only. Actual Products may vary due to seasonal availability, weather, pests, or crop conditions. We reserve the right to substitute similar items of equal or greater value.

Availability is subject to change. We do not guarantee stock levels and may cancel orders if Products are unavailable. Orders cancelled by us are eligible for refund to you.
2. Pricing and Payment

Prices are listed in USD and exclude taxes, delivery fees, or other charges, which will be added at checkout.

Payment is due at the time of order via accepted methods (e.g., cash, credit card, electronic transfer). We reserve the right to require full payment in advance for large or custom orders.

All sales are final unless otherwise specified. Prices are subject to change without notice, but orders placed prior to changes will be honored at the quoted price.
3. Orders and Delivery/Pickup

Ordering: Orders can be placed online, by phone, email, or in-person at markets/farm stands. Minimum order requirements may apply for delivery.

Delivery: We offer local delivery for a fee. Delivery times are estimates; delays due to weather, traffic, or farm operations are possible. Risk of loss transfers to you upon delivery.

Pickup: Self-pickup may be arranged under special circumstances but is not guaranteed.

Shipping: Limited shipping for non-perishables (e.g., dried herbs) via USPS or similar; perishable items (produce, poultry) are not shipped.
4. Returns, Refunds, and Cancellations

Due to the perishable nature of our Products, all sales are final. No returns or refunds will be issued except in cases of significant error on our part (e.g., wrong item delivered, contamination) or cancellation by us.

Cancellations must be requested at least 24 hours before scheduled delivery/pickup. Late cancellations may incur a fee up to 50% of the order value.

Refunds, if approved, will be processed within 7-10 business days via the original payment method.
5. Quality and Safety

We strive to provide high-quality, nutrient-dense Products free from synthetic pesticides, herbicides, and GMOs. However, as a small-scale operation, we cannot guarantee Products are 100% pest-free or uniform in size/shape/weight/quality.

Pastured poultry is processed humanely on-site or at inspected facilities in compliance with state regulations. All Products are sold "as is" and intended for immediate consumption or proper storage.

Customers are responsible for safe handling, storage, and cooking of Products. Follow USDA guidelines for food safety.

We are not liable for any allergic reactions, illnesses, or injuries real or perceived resulting from Product consumption, even if due to undeclared allergens (e.g., cross-contamination with nuts in herbal products).
6. Health and Liability Disclaimer

By purchasing, you acknowledge that regenerative farming involves natural variability, and Products may contain trace elements from soil or environment.

We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. Our total liability shall not exceed the purchase price of the affected Products.

You agree to indemnify us against claims arising from your misuse of Products or failure to follow safety instructions and guidelines from regulatory authorities.
7. Farm Policies

Visits and Tours: Farm visits are by appointment only. No pets, drones, or unauthorized photography. Children must be supervised. We are not liable for any injuries, illnesses, or conditions, real or perceived to anyone visiting any property owned or used by us.

Subscriptions/CSA: For Community Supported Agriculture shares, payments are non-refundable; shares may be adjusted for low yields but not increased.

Custom Orders: Special requests may incur additional fees and timelines.
8. Intellectual Property

Our farm name, logos, writing, general works and regenerative branding are protected. You may not use them without written permission.
9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Indiana, and the laws of the United States of America, without regard to conflict of laws principles.

Any disputes shall be resolved through mediation in Newton County, Indiana or if unsuccessful, in the courts of the state of Indiana. You agree to waive class action rights.
10. Privacy and Data

We collect personal information (e.g., name, address) for order fulfillment. We do not sell data to third parties but may share with service providers (e.g., payment processors).
11. Force Majeure

We are not liable for delays or failures due to acts of God, weather events, labor disputes, or other events beyond our reasonable control.
